Terms of use

Qaymeni — Customer experience and feedback management

1. Acceptance of and compliance with the terms

By creating a Qaymeni account, using the dashboard, sending feedback requests or using any platform service, the business customer acknowledges that it has read, understood and agreed to these terms. This obligation includes all users created within its account and all employees, agents or representatives using the platform on its behalf.

A person representing a company, establishment or business acknowledges that they have legal authority to bind it to these terms. Anyone lacking that authority or not accepting these terms must not use the platform, enter data or send feedback requests.

These terms form a binding agreement between Qaymeni and the business customer. Other terms submitted by the customer in a purchase order, correspondence or separate document do not bind Qaymeni unless expressly accepted in writing by an authorized Qaymeni representative.

2. Description of the service and its cloud nature

Qaymeni is a cloud SaaS platform that helps businesses manage feedback, complaints and digital reputation. Its technical tools include creating feedback requests, sending links through supported channels, collecting ratings, categorizing complaints, displaying analytics and producing reports to help businesses understand customer satisfaction.

The service is cloud-based; it is not the sale of standalone software, a license for a local copy or delivery of source code. A subscription does not grant the right to copy, download or run the system on the customer’s servers, or demand source code or raw databases, unless a separate written contract provides otherwise. It grants a limited, non-exclusive, non-transferable right to use the platform during the subscription term and only within the selected plan’s limits.

Features, interface design, menu names or report presentation may change over time for improvement, maintenance or technical compatibility. Reasonable changes do not constitute a breach by Qaymeni as long as the core service remains substantially available within the subscription’s scope.

3. Accounts and permissions

The business customer must provide correct and accurate registration information, including its business name, contact details, branch information and details of authorized account users. It must keep this information up to date because Qaymeni may rely on it for billing, notifications, support or identity verification.

The business customer is responsible for all activity through its account, whether by the owner, employees or anyone who obtains login details. It must manage permissions carefully, grant only the minimum necessary access and revoke access for staff no longer authorized to use the system.

Qaymeni may suspend an account or restrict access where there are indications of compromise, unlawful use, breach of these terms or unpaid fees. It may request additional information to verify the account owner’s identity or a user’s authority before reactivation.

4. The business customer’s legal obligations

The business customer must use the platform lawfully and comply with all applicable laws, regulations and policies, including personal data protection, communications, anti-spam, consumer protection and sector-specific requirements. It must not use the platform to circumvent legal obligations toward its end customers.

The customer must obtain appropriate consent before sending any feedback message, link or notification to an end user and provide evidence of that consent when needed. It must give clear privacy notices explaining that data may be used to measure satisfaction, improve service and manage complaints, and that feedback links may be sent through WhatsApp, email or another channel.

The business customer alone is responsible for message content, phone or email lists, sending times and frequency, and compliance with third-party policies such as those of WhatsApp and Google. It must not use Qaymeni to send unauthorized advertising, unlawful, misleading or unwanted content, or material that infringes others’ rights.

5. Subscriptions, billing and payment

Qaymeni offers monthly, annual or custom subscriptions as displayed on the website or agreed with the customer. Each plan has specified limits or features, such as branch and user counts, messaging volume, reports, integrations, support or service levels. Using features beyond the plan’s limits may require an upgrade or additional fees.

Fees are due in advance unless otherwise agreed in writing. Qaymeni may suspend or stop service for late payment after notice or the applicable grace period. Suspension does not release the customer from fees due for previous periods or charges accumulated through use of the service.

Unless a commercial offer or separate contract states otherwise, paid fees are non-refundable after activation or the start of the service period because the service provides access to a cloud platform and operating resources. Cancellation before the subscription ends does not entitle the customer to a refund for the remaining period unless required by applicable law or expressly provided in a written contract.

6. Renewal, cancellation and upgrades

A subscription may renew automatically if auto-renewal is enabled or agreed in the invoice or contract. In that case, the customer agrees to recurring charges through the approved payment method or a new invoice at the start of each subscription cycle. Customers who do not wish to continue must cancel renewal before the due date.

Customers may request an upgrade at any time. Prorated or immediate fees may apply under the pricing policy. A downgrade may take effect only at the start of the next billing cycle and may require reducing branches, users or features to meet the new plan’s limits.

Cancellation ends the right to use the service at the end of the paid term or on the cancellation date, according to the applicable policy. It does not necessarily delete data immediately. A limited retention period may apply for backups, compliance or transition, after which data may be permanently deleted or disabled.

7. Prohibited use and abuse

Customers must not use Qaymeni to send unwanted messages, contact people without appropriate consent, collect data fraudulently, impersonate others, publish abusive or illegal content, attempt to breach the platform, test its security without authorization, upload malicious files, disrupt service or deliberately exceed subscription limits.

The platform must not be used for review manipulation campaigns, forcing customers to give positive reviews, misleadingly concealing complaints or directing end users in ways that violate external review platforms’ policies. Qaymeni must be used to improve customer experience and address complaints, not to mislead the public or manipulate a business’s reputation.

If Qaymeni detects prohibited use or receives a serious complaint or a request from a competent authority, it may investigate, restrict features, suspend the account, delete offending content or terminate the subscription without liability to the customer, while reserving its right to seek compensation for harm.

8. WhatsApp, Google and external service integrations

Qaymeni may rely on external channels to send links, direct users or display external reviews. These may include WhatsApp, email providers, Google Reviews, Google Maps, payment gateways or other connected providers. Their own terms and policies apply, and they may change, stop or impose restrictions outside Qaymeni’s control.

Qaymeni does not guarantee that WhatsApp will accept every message, that a customer’s number or account will not be blocked or restricted, that messages will always arrive, or that external APIs will retain the same prices or capabilities. It does not guarantee publication, removal, ranking or visibility of Google reviews, which depend on Google’s systems, policies and algorithms.

The business customer is responsible for complying with WhatsApp, Google and other providers’ policies, including consent, message templates, sending rates, permitted content and review policies. Third-party blocking, restriction, rejection or disabling is not a breach by Qaymeni and does not give rise to compensation or a refund unless clearly established to result from Qaymeni’s direct gross error.

9. Limits of liability and disclaimer of warranties

Qaymeni provides the service “as is” and “as available.” It gives no express or implied guarantee that the service will be error-free, uninterrupted or suitable for every particular customer need, unless specific warranties are agreed in writing in a separate contract. Qaymeni does not guarantee that using the platform will increase reviews, improve sales, prevent negative reviews or resolve all complaints.

Qaymeni is not liable for indirect, consequential, special or incidental losses, including lost profits, reputational loss, lost business opportunities, business interruption, end-customer claims, penalties arising from the customer’s legal violations or harm resulting from improper platform use.

In all cases, to the maximum extent permitted by law, Qaymeni’s total liability for a service-related claim is limited to the amount the customer actually paid Qaymeni for the service concerned during the three months before the event giving rise to the claim. This excludes third-party fees and external costs.

10. Indemnification and protection against claims

The business customer must indemnify Qaymeni, its management, employees, suppliers and partners against claims, losses, penalties, expenses, legal fees or harm arising from the customer’s use of the platform in breach of these terms, applicable law or others’ rights. Examples include messaging without consent, entering unlawfully collected data, spam, breaches of WhatsApp or Google policies, or violations of privacy or intellectual property rights.

If Qaymeni receives a claim from an end user, government body or third party because of the customer’s platform use, it may require full cooperation and documents, consent records and other evidence demonstrating lawful data use. If the customer fails to provide this, it bears all resulting consequences and costs.

This indemnity does not limit Qaymeni’s other rights, including suspension, termination, seeking compensation through the courts or taking technical measures to prevent continued violations.

11. Force majeure and service continuity

Qaymeni is not responsible for delay, interruption or failure caused by events beyond its reasonable control, such as natural disasters, wars, government decisions, general internet outages, hosting provider failures, widespread cyberattacks, WhatsApp or Google outages, payment gateway issues or other events that reasonable measures could not prevent.

In a force majeure event, Qaymeni will make reasonable efforts to restore service or reduce the disruption’s effect using available resources. This does not create an automatic right to compensation or refunds unless a separate SLA states otherwise.

The customer acknowledges that cloud services depend on a chain of providers, connections and systems, and that availability is affected by multiple factors not all within Qaymeni’s control.
